General terms and conditions valid from 01.01.2023



scope


    The general terms and conditions (GTC) regulate the business relationship between Pferdetherapie Linda Visser, Linda Visser and the animal owner, animal keeper, animal owner, authorized representative or person authorized to dispose of the animal, hereinafter referred to as "animal keeper", within the meaning of §§ 611 ff BGB, unless otherwise agreed in writing between the contracting parties. The general terms and conditions also apply to all future business relationships, even if they are not expressly agreed again.



Contractual partner, conclusion of contract


    The treatment contract is concluded when the animal owner accepts the therapist's general offer to carry out physiotherapy and other treatments and turns to the therapist for the purpose of advice, diagnosis and therapy. If consent or agreement is given verbally, in writing (email) or by telephone, the treatment contract is deemed to have been granted. These General Terms and Conditions come into force when the treatment contract is concluded. However, the therapist is entitled to refuse a treatment contract without giving reasons, in particular if the necessary relationship of trust cannot be expected, if the complaints are which the therapist cannot or may not treat due to his specialization or for legal reasons, or which could cause him to have a conflict of conscience, if the animal owner fails to comply with his duty of care, refuses treatment instructions, the therapy is given due to a lack of cooperation, e.g. the necessary information on anamnesis and diagnosis is given inaccurately or incompletely and therapy measures are thwarted. In this case, the therapist's right to remuneration for services rendered up to the time of rejection, including consultation, remains intact.



Content and purpose of the treatment contract


    The therapist provides his services to the patient/animal owner by applying his knowledge and skills in the practice of physiotherapy and alternative veterinary medicine to diagnose and treat the patient. The animal owner decides freely on the diagnostic and therapeutic methods according to his own sensitivities after he has been fully informed by the therapist about the applicable methods and their advantages and disadvantages in technical and economic terms. If the animal owner does not decide or cannot decide, the therapist is authorized to use the method that corresponds to the presumed wishes of the animal owner. As a rule, the animal therapist uses methods that are not recognized by conventional medicine and do not correspond to the current state of science. These methods cannot generally be explained in causal-functional terms and are therefore not targeted. In this respect, a subjectively expected success of the method can neither be promised nor guaranteed.The therapist may not issue sick notes or prescribe prescription drugs.An animal therapeutic treatment is not a substitute for veterinary treatment, but rather an accompanying supplement.



Participation of the animal owner


    The animal owner is not obliged to actively participate. However, the therapist is entitled to terminate treatment if the necessary relationship of trust no longer appears to exist, in particular if the animal owner denies the content of the consultation, provides inaccurate or incomplete information on the anamnesis and diagnosis, or thwarts therapy measures. The therapist is not liable for injuries or other damage to the animal caused by the animal owner through participation in the therapy. The therapist does not guarantee that the therapy or training goal will be achieved. The therapy and training are tailored to the needs of the customer and the capabilities of the animal according to its type, breed, age, gender and physical condition. The animal owner is advised that the training content and therapies taught by Linda Visser, Linda Visser's horse therapy can only achieve optimal and lasting success if they are consistently implemented outside of the lessons or therapy sessions. In order to achieve optimal treatment success, regular therapeutic treatment sessions and compliance with homeopathic and behavioral therapy treatment recommendations are essential; for therapeutic treatments, the animal owner's cooperation outside of the treatment sessions is required.



Remuneration of the animal therapist


    The animal therapist is entitled to a fee for his services as agreed individually with the animal owner.The animal therapist is entitled to a fee for his services. If the fees are not agreed individually between the animal therapist and the animal owner, the prices listed in the current price list apply. The application of other fee schedules or fee lists is hereby excluded.Appointments that the customer does not cancel at least 24 hours before the appointment will be invoiced to the customer and must be paid within two weeks of the invoice date. Important reasons in the form of force majeure according to the German Civil Code that must be communicated immediately and proven are excluded from this invoice.The animal owner must pay the therapist in cash for each day of treatment. Payment on account can only be agreed upon after consultation before the start of treatment. After a reminder procedure, only cash payment is possible.The animal physiotherapist undertakes to send only one reminder, for which the reminder fee is an additional €5.00.If payment is not made within the statutory period, the matter will be handed over to a debt collection agency without further notice and the judicial reminder procedure will be initiated.Travel costs will be charged for the journey to the place of service. The amount of the travel costs per km can be found in the current price list.

Therapies, therapy plans, documents, or similar may not be reproduced (even in extracts) or passed on to third parties without the express written permission of the animal therapist.



Liability


    The animal owner/authorized person is directly and fully liable for all damage caused to persons, practice equipment and practice furnishings by him or the animal.



Disclaimer

Any examination/treatment/riding/lunging or handling of a horse can generally result in risks or damage to the animal, the handler, helper or the environment. The handler expressly accepts no liability in this regard, as well as for consequential damage.


Valid animal liability insurance is required for each treatment order from the owner.



Confidentiality of treatment


The therapist treats the patient data confidentially and only provides information regarding the diagnosis, consultations and therapy as well as the circumstances surrounding the patient with the express written consent of the animal owner. The written form requirement can be waived if the information is provided in the interest of the animal owner and it can be assumed that the animal owner will consent.



Disagreements

Disagreements arising from the treatment contract and the general terms and conditions should be settled amicably. To this end, it is advisable to submit any objections, differing opinions or complaints to the other contracting party in writing.



Severability clause


Should individual provisions of the treatment contract or the general terms and conditions be or become invalid or void, this will not affect the validity of the treatment contract as a whole. Rather, the invalid or void provision is to be freely interpreted and replaced by a provision that comes closest to the purpose of the contract and the will of the parties.
